INTRODUCTION
A duly executed document means that it is signed with the proper protocol. This may include signatures, dates, witnesses, apostille, and notarization. If a document is not executed properly, it may not be legally valid or admissible and can also bring hassles in the way of litigation.
Proper execution of a contract preserves the integrity and authenticity of documents and serves as a safeguard to prevent document fraud & identity theft.
Henceforth it is suffice to say that a duly executed contract essentially forms a legally binding contractual relationship.
The term, a fully executed contract can be used to reference the fact that all parties to the contract have acknowledged the document by means of signature, notarization, attestation, apostille etc., which shall be the scope of this thesis.
After one party had signed the contract, it would not yet necessarily be fully executed. Each party certainly must sign the contract, in some cases even relatives to the parties who are in some way associated with the contract are required to acknowledge and authenticate the documents for certain transactions such as buying, selling or leasing property, power of attorney, business agreements need to be documented, especially those with a financial aspect to it.
In the realm of legal agreements and formal commitments, the role of a duly signed, attested, and stamped contract cannot be overstated. Contracts serve as cornerstones for countless interactions, from business transactions to personal arrangements, embodying the binding promises and obligations between parties involved. Their significance lies not only in the content they convey but also in the authentication and validity they carry.
This project delves into the crucial importance of ensuring that contracts are appropriately executed with valid signatures, proper attestation, and the necessary stamps. By exploring the legal, financial, and practical ramifications of a well-constructed contract, this study aims to shed light on the essential factors that contribute to their effectiveness and enforceability.
