Abstract:
The online gaming industry in India has witnessed a remarkable transformation over the past decade, propelled by technological advancements and increasing internet penetration. However, this sector’s regulatory framework remains fragmented and inconsistent across states, creating a complex labyrinth for operators, players, and policymakers to navigate. This article comprehensively analyses the constitutional framework, judicial interpretations, and the pressing need for uniform legislation to regulate online gaming in India effectively. This article presents a holistic perspective on the legal landscape surrounding online gaming by delving into the historical context of gaming regulations, the division of legislative powers between the Centre and states, key Supreme Court rulings, and the challenges posed by the current regulatory ambiguity. It further explores the potential benefits of a comprehensive central regulatory framework, proposes recommendations for a cohesive legal environment, and emphasises the importance of balancing fostering innovation and ensuring consumer protection.
