Abstract
Despite legal provisions guaranteeing equality, men may face discrimination and violations of their rights in various spheres, including the workplace, family, and legal proceedings.In contemporary discourse on gender equality and human rights, the focus often revolves around women’s rights, while men’s rights remain relatively underexplored. This study aims to address this gap by analyzing the status of men’s rights as human rights in India. Specifically, the research seeks to understand the extent to which men are afforded equal protection under the law and to identify any disparities or challenges in the enforcement of their rights.
The paper titled, “Equal Protection Under the Law: Analyzing Men’s Rights as Human Rights” examines the question of equal protection under the law, especially in respect to men’s rights as human rights. While gains have been made in respect to human rights across the globe, there is a rising awareness that men’s rights continue to be ignored under law and in society. This research aims to analyze the extent to which men are afforded equal protection and to identify any disparities that exist in the enforcement of their rights.
The research addresses several key areas: family law, workplace discrimination, domestic violence, and access to legal recourse. By examining these domains, the study seeks to provide a comprehensive understanding of the challenges men face and the systemic factors that contribute to the inequities.
Using a mixed-methods approach, the study incorporates quantitative data from legal case reviews and surveys with qualitative insights from interviews with legal experts, social workers, and affected individuals. Preliminary findings indicate significant gaps in the protection of men’s rights, particularly in areas related to family law and domestic violence, where men are less likely to receive support and recognition as victims. Additionally, workplace discrimination against men, particularly in non-traditional roles, remains a concern. The study highlights the need for legal reforms and societal shifts to ensure that men’s rights are upheld as integral to human rights.
