CYBERCRIME AND THE CONSTITUTIONAL RIGHT TO EQUALITY: EXAMINING DISCRIMINATORY PRACTICES IN DIGITAL SPACES – Aayush Tiwari

ABSTRACT

The intersection of cybercrime and constitutional rights reveals significant challenges in upholding the right to equality in digital spaces. This study investigates how discriminatory practices persist in online environments, analyzing their impact on marginalized communities and highlighting the limitations of current legal frameworks in addressing digital inequalities. The research examines case studies of targeted online harassment, bias in algorithmic decision-making, and surveillance practices, emphasizing how these elements disproportionately affect specific social groups. By scrutinizing existing legal protections under constitutional law, this paper proposes legal and policy reforms that address these disparities. Through a multi-disciplinary approach combining legal analysis and cyber studies, the research underscores the urgent need for equitable online protections. It advocates for enhanced awareness among policymakers and cybersecurity stakeholders to ensure that digital spaces do not perpetuate discrimination but rather support an inclusive society. Findings suggest that upholding equality in cyberspace requires not only legal reforms but also broader societal commitment to digital justice.
