ABSTRACT:

In modern democracies, people talk a lot about how much impact the courts have on making sure things are fair and keeping society happy This article looks at both sides of Public Interest Litigation (PIL) and what judges do, seeing how they can change society the better and how they affect how democracy works. By looking at important court cases and what experts think, this research looks closely at whether judges getting involved through PIL is needed to make up for when lawmakers don’t do enough and to protect people who are in the minority. It also asks if judges sometimes go against democratic ideas by not listening to the lawmakers who the people elected. By digging into all this, this article wants to show you exactly how PIL and judges taking action impact how laws work nowadays, showing if it helps society be better off while keeping democratic ideas in check.
