LEGALIZING SEX WORK AS A TOOL FOR EMPOWERING MARGINALIZED WOMEN: A FEMINIST LEGAL PERSPECTIVE IN THE INDIAN CONTEXT – Sai Charan Isukapalli

Abstract

This research paper seeks to discuss the following research question: To what extent legalisation of sex work can be regarded as empowering the vulnerable women under the lens of India socio-legal jurisprudence? Based on the above, this paper aims at finding out the extent to which socio-economic vulnerability of women and gendered legal framework in the regulation of sex work contributes to the understanding of the subject matter. This paper aims at analyzing the current legal position on the legalization of prostitution, arguments in favor of and against it by feminism as well as the experiences of the countries where prostitution is legal or decriminalized. The study also looks at the impact on women’s agency, income generating ability and human dignity and the consequences of the process of legalizing the sex work in India.
