INTELLECTUAL PROPERTY LAWS IN THE MUSIC INDUSTRY – Karthik B Harish

Abstract

The Indian entertainment and media industry has grown to a tremendous degree in term of its number of outlets and individual publishers, content generation and employment of advanced technology. With an increase in a product’s commercial and social popularity, laws are required to bring about a regularized cohesiveness in society. This is why Intellectual Property Rights (IPR) is becoming an ever increasing need in the modern internet fuelled age. With various industries in India and around the world growing steadily, especially in regard to the music industry, there have been various instances of violation of IP rights despite the government’s attempt to curb IP infringement through various laws such as the Copyright Act, 1957 and the Copyright (Amendment) Rules, 2021. With the industry being as diverse as it is, it is becoming increasingly difficult for the legal system to aid violations of IP rights, thus it poses a greater challenge to the entertainment industry as a whole.
