Abstract
The Right to be Forgotten is an underlying right under the Right to Privacy, as laid down by the Supreme Court of India. This right relieves various individuals who wish their data to be erased from the public domain. However, it fails to serve those most vulnerable to loss of reputation due to their sensitive information being readily accessible to the public. Alleged criminals and convicts are subject to the particulars of their court proceedings being published electronically when orders and final judgements are passed, which reveal the nature of their offence. This is detrimental to the future of such persons since a simple Google search would inform a prospective employer of the violationsthey committed. Therefore, this paper examines whether the Right to be Forgotten should extend to persons involved in criminal cases.
