ABSTRACT
This study scrutinizes the intricate landscape surrounding the implementation and enforcement of foreign arbitral awards, offering a meticulous analysis with a particular focus on the challenges prevalent within the Indian legal system. In an era of expanding global commerce, international arbitration has become the preferred method for resolving cross-border disputes. However, the effectiveness of this mechanism relies significantly on the smooth execution of foreign arbitral awards, a process fraught with multifaceted challenges.
The study culminates in a set of comprehensive recommendations and reform proposals. Envisioning legal reforms in India, the research proposes strategies to fortify the enforcement machinery. Additionally, it underscores the pivotal role of institutional initiatives and collaborative efforts in overcoming challenges associated with the implementation and enforcement of foreign arbitral awards in India.
