DALIT DISCRIMINATION IN INDIA CONCERNING CASES IN ASSAM: UNVEILING THE HIDDEN INEQUALITIES – Nirzana Banikya

Abstract

Dalit jurisprudence as a path of equality is a way of understanding and using the law to promote social justice and challenge caste-based discrimination. The paper focuses on the experiences and perspectives of Dalits facing injustice and oppression since time immemorial. It excavates the hidden histories of the marginalised communities, their struggle for upliftment, and the various measures of the government and the lawmakers rendering social justice envisaged in the Constitution of India, ensuring that the voices of the Dalit are not left out. However, despite progress, discrimination against Dalits and other minorities persists. In addition to exploring the broader themes of Dalit jurisprudence, this paper also ventures into the challenges faced by these communities in the region of Assam. What secrets lie hidden behind the veil of social hierarchy? How do the whispers of the past inform the struggles of the present? This paper embarks on a journey to uncover the concealed narratives of Dalit communities and the underlying discrimination.
