ABSTRACT:
Conveyance transfers the title, ownership, and interest of land in Favor of an entity. It is a binding contract that is enforceable in a court of law. Under Section 11 of the Maharashtra Ownership Flats Act (MOFA), the builder/developer is duty-bound to convey the land to the society within 4 months from the date of registration of the society.
However, if the Developer fails to execute conveyance in Favor of the society, then as per Section 10 (3) of MOFA, the legal entity i.e. the society can approach the Competent Authority and submit the documents required for obtaining a unilateral conveyance.
Deemed conveyance is a process in which the legal entity i.e. housing society can obtain unilateral conveyance even without the support of the builder/developer and land-owner.
